On 16 June 2020, I represented a strata property owner seeking to set aside a Strata Management Tribunal award. My client instructed me to file a judicial review application to set aside the Tribunal’s refusal to allow his claim. Leave was granted by the High Court to commence the proceedings.
My client claimed the management committee of his strata property allowed several “unqualified residents” to attend and vote at the AGM held last year. Worse, several resolutions were passed at the AGM contravening the clear provisions of the Strata Management Act 2013. Yet, the Tribunal dismissed his claim. Hence, the current judicial review application before the Penang High Court.
